    Canada’s Anti-Spam Legislation establishes complex new rules for anyone sending email or other forms of electronic messaging, which is reinforced with significant penalties for non-compliance. Now that regulations under the legislation are nearly finalized, it is time for organizations to begin preparing by conducting an audit of existing and future practices, identifying risks, and developing a compliance program.

    The speakers – Shaun Brown and Matt Vernhout – will provide valuable information based on first-hand experience in conducting compliance audits.     Canada’s Anti-Spam Legislation (CASL) is expected to be finalized this year. When it comes into force, CASL will take a prohibitive approach to “Commercial Electronic Messages”, to eliminate spamming, hacking, malware, fraud, harvesting and privacy invasions. With hefty new penalties for sending commercial electronic communications without the consent of the recipient, including a maximum fine of $10 million, you need to be fully prepared to ensure compliance now. This session will guide you to prepare your organization for the implementation of the CASL.

    Understanding the electronic messages requirements under the CASL to know what are the:

    • commercial electronic messages
    • message classes exempt
    • disclosure requirements for electronic messages
    • requirements for third party service providers
    • Assessing your regulatory environment as a starting point
    • Auditing your existing process to build on the data you already have
    • Establishing a compliance strategy based on your own practice
    • Operationalizing the requirements with adequate systems
    • Determining the required changes to your databases and customer relationship management systems
    • Evaluating your internal training requirements to prepare for the implementation
